Organisational model – Legislative Decree 231/2001

What this is about
Italian Legislative Decree no. 231/2001 establishes administrative liability of companies for certain offences committed in their interest or to their advantage. A company can be exempted from this liability if it has adopted and effectively implemented a suitable organisational model beforehand. This is what the cooperative has done.
What the model contains
The model consists of a general part and a special part:
The general part describes the purpose, structure and principles of the model, the supervisory body with its duties and reporting obligations, and the disciplinary system.
The special part works through the individual risk areas – among them offences against the public administration, corporate offences, occupational safety and health protection, data processing, money laundering, environmental offences and tax offences. For each area it sets out the processes concerned, the objectives and the applicable rules of conduct.
Code of ethics
The organisational model is accompanied by a code of ethics. It sets out the values and principles of conduct followed by everyone who works for the cooperative: employees, members, governing bodies, suppliers and consultants.
Supervisory body and reports
A dedicated supervisory body monitors compliance with and the effectiveness of the model. Breaches of the organisational model may be reported exclusively through the internal reporting channel. The Whistleblowing page explains how.

The organisational model is available in German and Italian, the code of ethics as a single bilingual document. There is no English version of these documents; the Italian version is authoritative.
